| The
Mental Health Act
The Mental Health Act describes conditions under which people
are admitted to and treated in mental health facilities (hospitals)
in Ontario.
Basically, if a person is a danger to themselves or to others
the Mental Health Act allows a doctor (by completing a Form
1) or a justice of the peace (by completing a Form 2) to hospitalize
that person involuntarily for a period of three days for a
psychiatric assessment.
The legislation has been recently amended to provide for
community treatment orders (CTOs), which allow some people
who would have been hospitalized involuntarily before, to
receive treatment and support in the community under certain
conditions.
The Mental Health Act also contains provisions that cover
the collection, release and transfer of patient information.
This part of the Act ensures confidentiality.
